Intellectual Property Policy

This Intellectual Property Policy outlines the guidelines and rights related to the use, protection, and ownership of intellectual property (IP) within the Printsuite plugin (the "Plugin"), owned and operated by Storefront.com Online Inc. ("Storefront," "we," "us," or "our"). By using the Plugin, you ("User") agree to abide by this policy, in addition to our Terms and Conditions and Privacy Policy.

1. Ownership of Intellectual Property

  • Plugin IP: All intellectual property rights in and to the Plugin, including but not limited to code, design, interface elements, trademarks, logos, documentation, and any other content created by us, remain the exclusive property of Storefront. User is granted no ownership rights to any aspect of the Plugin, except for the limited license described in our Terms and Conditions.
  • Trademarks and Branding: "Printsuite," the Printsuite logo, and any related brand elements are trademarks of Storefront. User agrees not to use our trademarks or branding without explicit written permission.

2. User-Generated Content

Users may create and upload content through the Plugin, such as designs, graphics, text, and other media, to facilitate the creation of print-on-demand products. This content, referred to as "User Content," is subject to the following terms:

  • User Ownership: Users retain ownership of all intellectual property rights to their User Content. We do not claim ownership over User Content, but by using the Plugin, User grants us a limited, non-exclusive, royalty-free license to use, reproduce, and display User Content solely for the purpose of providing, improving, and promoting the Plugin.
  • Responsibility for IP Compliance: Users are solely responsible for ensuring that their User Content complies with applicable intellectual property laws. Users represent and warrant that they hold all necessary rights, permissions, or licenses to upload, use, and distribute their User Content through the Plugin.

3. Prohibited Uses of the Plugin

  • Copyright and Trademark Infringement: Users are prohibited from uploading, using, or distributing content that infringes on the copyrights, trademarks, or other IP rights of third parties. This includes the unauthorized use of images, text, logos, or any other copyrighted or trademarked material.
  • Counterfeit and Unauthorized Goods: Users may not use the Plugin to produce counterfeit or unauthorized goods that infringe on any third-party IP rights, including branded products or replicas.
  • Respect for Publicity and Privacy Rights: Users may not upload or use content featuring identifiable individuals (such as celebrities or public figures) without proper authorization. This includes any use that would infringe on publicity or privacy rights.

4. Reporting IP Violations

If you believe your intellectual property rights have been infringed by User Content on the Plugin, please contact us at dcma@printsuite.com with the following information:

  • Identification of the IP claimed to be infringed, including registration details if applicable.
  • Identification of the specific content alleged to infringe on your IP.
  • Contact details, including your name, address, and email address.
  • A statement confirming your good faith belief that the use of the content is not authorized by the IP owner, its agent, or the law.
  • A statement confirming the accuracy of your report and your authority to act on behalf of the IP owner.

Upon receiving a valid report, we may take appropriate action, including removing the allegedly infringing content, suspending the User’s access to the Plugin, and/or notifying the User of the complaint.

5. DMCA Compliance (For U.S.-Based Companies)

In compliance with the Digital Millennium Copyright Act (DMCA), we will respond to valid takedown requests regarding alleged copyright infringement on our Plugin. If you are a rights holder and believe content hosted by our Plugin infringes your copyright, please follow the process in Section 4, including all information required for a DMCA takedown request.

6. Consequences of IP Policy Violations

If we determine that a User has violated this IP Policy, we may take one or more of the following actions:

  • Remove or disable access to infringing content.
  • Issue a warning to the User or require removal of infringing content.
  • Suspend or terminate the User’s access to the Plugin.
  • Pursue any additional remedies available under law.

7. Changes to this Policy

We reserve the right to update or modify this Intellectual Property Policy at any time. Continued use of the Plugin after changes to this policy constitutes acceptance of the updated terms. Users are encouraged to review this policy periodically.
